Welcome to Simplified Moving Solutions (“SMS,” “we,” “us,” “our”). These Terms of Use (“Terms”) govern your access to and use of our websites and services, including https://simplifiedmovingsolutions.com/ and any tools, forms, emails, or features we provide (collectively, the “Services”).
By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1) Who we are and what we do

SMS operates a moving-company marketplace. We help people planning a move request quotes and connect with moving companies and related providers (collectively, “Movers”). We do not provide moving services ourselves and are not a motor carrier. Movers are independent third parties who set their own prices, schedules, and policies.

No guarantee of results or pricing. Quotes are estimates supplied by Movers and may change after an on-site or virtual survey. We do not control, and are not responsible for, Movers’ actions, performance, insurance, licensure, or availability.

2) Eligibility

You must be at least 18 years old and able to enter a binding contract to use the Services. You may use the Services only in compliance with these Terms and all applicable laws.

3) Your account and accuracy of information

You are responsible for any activity under your account and for keeping your login details secure. You agree to provide accurate, current, and complete information (e.g., move origin/destination, dates, inventory, contact details) and to update it as needed.

4) Lead requests and communications consent

When you submit a quote request or otherwise express interest, you authorize us to share your information (e.g., name, email, phone, move details) with selected Movers so they can provide estimates and contact you.

Calls and texts (TCPA notice). By providing a phone number, you agree that SMS and/or Movers may contact you by phone or SMS (including via autodialed or prerecorded messages) regarding your request. Consent is not a condition of purchase. Message and data rates may apply. You can opt out at any time (e.g., reply STOP to SMS).

5) Marketplace relationship; disputes with Movers

We are not a party to contracts between you and any Mover. If a dispute arises about pricing, timing, loss/damage, claims, or service quality, that dispute is between you and the Mover. You agree to pursue remedies directly with the Mover and their insurer. Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.

6) User content: reviews, messages, feedback

You may be able to post or submit content (e.g., reviews, ratings, messages, photos, feedback) (“User Content”).

• Your responsibility. Do not post unlawful, misleading, defamatory, harassing, infringing, or private information; do not impersonate others; and do not include sensitive data (e.g., government IDs, payment card numbers).
• License you grant us. You grant SMS a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for formatting), publish, display, and distribute your User Content in connection with operating, marketing, and improving the Services.
• Right to moderate. We may (but have no obligation to) review, remove, or refuse User Content at our discretion.

You represent that you own or have the necessary rights to the User Content you submit.

7) Acceptable use

You agree not to:

• Use the Services for any unlawful purpose or to violate others’ rights.
• Scrape, crawl, or harvest data without our written consent.
• Reverse engineer or circumvent security or access controls.
• Post or transmit malware, spam, or deceptive content.
• Misrepresent your identity or affiliation.
• Interfere with the proper working of the Services.

We may suspend or terminate access for violations.

8) Intellectual property

The Services (including text, graphics, logos, software, and compilations) are owned by or licensed to SMS and are protected by IP laws. Except for the limited rights to use the Services as permitted by these Terms, no licenses are granted. You may not use our trademarks, trade dress, or branding without prior written permission.

9) Privacy and cookies

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, share, and safeguard information, including cookies, analytics, and ads technologies. Where applicable, we honor certain opt-out mechanisms (e.g., Global Privacy Control) as described in the Privacy Policy.

10) Third-party sites, tools, and integrations

The Services may link to third-party websites, apps, tools, or payment providers. We do not control or endorse third-party content and are not responsible for their policies or practices. Your use of third-party services is at your own risk and may be subject to their terms and privacy policies.

11) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, SMS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that quotes will meet your expectations, that Movers will be available or perform to any standard, or that the Services will be uninterrupted, secure, or error-free.

Some jurisdictions do not allow the disclaimers above; in that case, they apply to the maximum extent permitted.

12) Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SMS OR OUR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED US $100.

Some jurisdictions do not allow certain limitations; in that case, the limits apply to the maximum extent permitted.

13) Indemnification

You agree to defend, indemnify, and hold harmless SMS and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your interaction or contract with any Mover.

14) Changes to the Services and to these Terms

We may modify or discontinue all or part of the Services at any time. We may update these Terms by posting the revised version with a new “Last updated” date. Material changes will be communicated as required by law. Your continued use of the Services after changes become effective constitutes acceptance.

15) Termination

You may stop using the Services at any time. We may suspend or terminate your access immediately if we believe you violated these Terms, created risk or possible legal exposure for us or others, or for any reason with or without notice, as allowed by law. Upon termination, Sections that by their nature should survive (e.g., 6, 8, 11–19) will survive.

16) DMCA / copyright policy

If you believe content on the Services infringes your copyright, send a notice including the information required by 17 U.S.C. §512(c)(3) to:

17) International users

We operate primarily in the United States. If you access the Services from other countries, you do so on your own initiative and are responsible for compliance with local laws. See our Privacy Policy for information on international data transfers and your rights.

18) Miscellaneous

• Entire agreement. These Terms plus our Privacy Policy are the entire agreement between you and SMS about the Services.
• Severability. If a provision is unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce a provision is not a waiver.
• Assignment. You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or sale of assets.
• Headings. Headings are for convenience only.
